The Supreme Court expressed its dissatisfaction with the way the Himachal High Court wrote the ruling. The judge, who is involved in the hearing that heard the case, said: “After reading the ruling, we prepared to apply Tiger Balm.” The decision should be in simple language, and it should not be a thesis.
Panel of Judges DY Chandrachud and Judge MR Shah heard a special permission petition filed against the Supreme Court ruling. Judge Shah said that I couldn’t understand anything in the verdict. There are big sentences in it. Some did not understand what was said at the beginning and what was at the end. There was a zombie stuck in a strange way. I began to doubt my understanding of reading the verdict.
The Supreme Court said, the decision should be in simple language, which the general public should understand.
After reading the last paragraph, I had to apply Tiger Balm. Meanwhile, Judge Chandrashud said the decision should be written in a way that the average person could understand. I started reading the verdict at 10.10 in the morning and when I finished at 10.55 in the evening you cannot understand how it felt.
My condition is unimaginable. Referring to Judge Krishna Iyer’s decisions, Judge Chandrashud said that his decisions were simple and clear, and readers had no difficulty understanding them.
Actually, this case concerns a government employee. The employee was sanctioned by the Central Government Industrial Court (CGIT), for alleged misconduct. The employee appealed the decision in the Himachal Pradesh High Court. The Supreme Court upheld the CGIT decision. Then the employee went to the Supreme Court.
